Terms of Service

These terms apply to use of the Graze & Grace website and to orders, quotes, bookings, deliveries, setups, and services unless a separate written agreement says otherwise.

Effective: August 27, 2026

Attorney-review draft. Your attorney should review these terms before final production use, especially payment, cancellation, liability, venue, and governing-law provisions.

1. About These Terms

By using this website, placing an order, accepting a quote, paying an invoice or retainer, or receiving services from Graze & Grace, you agree to the terms that apply to that transaction. If an accepted quote, invoice, or written event agreement contains more specific terms, those specific terms control for that order or event.

2. Services and Availability

Graze & Grace provides charcuterie, grazing displays, boxes, boards, cups, carts, catering, popups, guest welcomes, and related event services. Availability depends on date, location, staffing, ingredients, equipment, travel, and event requirements. Submitting a form or requesting a quote does not guarantee availability or reserve a date.

3. Quotes, Orders, and Booking

A custom event becomes confirmed only after Graze & Grace accepts the booking and any required deposit, retainer, or payment stated in the quote or invoice has been received. Quotes may expire after the period stated in the quote. Changes to scope, guest count, location, timing, menu, rentals, or setup requirements may change pricing.

4. Pricing and Payment

Pricing may include food, preparation, styling, delivery, travel, setup, staffing, rentals, service time, taxes, or other charges as stated in the order or quote. Payment terms and due dates are provided with the applicable order, invoice, quote, or event agreement.

5. Changes, Cancellations, and Refunds

Changes are subject to availability and may affect price. Cancellations and refunds are governed by our Refund & Cancellation Policy and any specific written terms in your quote, invoice, or event agreement.

6. Ingredient Availability and Substitutions

Charcuterie is built with fresh and seasonal ingredients, and specific brands, varieties, produce, florals, accompaniments, colors, or presentation materials may become unavailable. Graze & Grace may make reasonable substitutions of similar quality, style, function, or value when needed. We will make reasonable efforts to preserve the overall look, dietary request, and experience you approved.

7. Allergies and Dietary Requests

You are responsible for telling us about known food allergies, dietary restrictions, and other food-related concerns before the order is confirmed. We can often accommodate preferences, but we do not represent that our preparation, assembly, transportation, or service environment is free of common allergens or cross-contact. People with severe or life-threatening allergies should use appropriate caution and make decisions based on their individual medical needs.

8. Food Safety After Delivery or Setup

After delivery, handoff, or completion of an unattended setup, the client or receiving party is responsible for appropriate refrigeration, temperature control, protection from contamination, and timely consumption unless Graze & Grace is specifically contracted to provide ongoing staffed food service. As a general safety rule, keep cold perishable food at 40°F or below and do not leave perishable food unrefrigerated for more than two hours, or more than one hour when the temperature is above 90°F.

9. Delivery, Venue, and Property Access

You are responsible for providing accurate addresses, contact information, access instructions, parking information, gate codes, elevator or stair information, venue rules, loading restrictions, and setup windows. Someone authorized must be available when required. We will not enter a private residence, rental property, or restricted area without appropriate permission.

10. Outdoor Events and Weather

Outdoor service requires a safe and reasonably protected setup area. Direct sun, heat, rain, wind, insects, uneven ground, or other conditions may affect food safety, equipment, or presentation. Graze & Grace may modify or decline an unsafe setup. The client is responsible for a suitable backup location when weather could affect the event.

11. Equipment, Rentals, and Property

If reusable boards, risers, carts, serving pieces, décor, linens, or other rental items are provided, any return requirements, pickup times, damage fees, cleaning expectations, or replacement charges will be stated in the applicable quote or agreement. The client is responsible for reasonable care of rental items while they are in the client’s control.

12. Photos and Marketing

Graze & Grace may photograph our food, boards, displays, carts, and setups for portfolio or marketing use when doing so does not improperly disclose private personal information. If you do not want an event setup photographed or shared, tell us in writing before the event. We will not intentionally publish private guest information without permission.

13. Website Content and Intellectual Property

The Graze & Grace name, logo, original photographs, website design, written copy, graphics, and other original content are protected by applicable intellectual-property laws. You may view the site for personal or business purchasing purposes, but may not copy, republish, sell, scrape, or commercially exploit site content without permission.

14. Third-Party Services

The site may use third-party providers for hosting, forms, email, payment processing, analytics, maps, social media, or other website integrations. Those services may have their own terms and privacy practices. Graze & Grace is not responsible for third-party services outside our reasonable control.

15. Disclaimers

We work to provide accurate website information, but availability, pricing, menu items, ingredients, photos, and service descriptions may change. Photos are examples and handmade food arrangements will naturally vary. Nothing on this site is a promise that every order will be visually identical to a photograph.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Graze & Grace is not liable for indirect, incidental, special, punitive, or consequential damages arising from site use or services. Nothing in these terms limits liability that cannot legally be limited or waived. Any transaction-specific limitations in a signed or accepted written agreement also apply.

17. Client Responsibility and Indemnity

To the extent permitted by law, the client is responsible for losses or claims caused by inaccurate information supplied by the client, unauthorized property access arranged by the client, unsafe event conditions under the client’s control, misuse of food or equipment after handoff, or failure to disclose material venue or allergy information. Your attorney may revise this section to fit the final business structure and insurance coverage.

18. Force Majeure

Graze & Grace is not responsible for delays or inability to perform caused by events beyond reasonable control, including severe weather, natural disasters, government actions, emergencies, major transportation disruptions, widespread utility outages, or significant supplier interruptions. We will work in good faith on a reasonable solution when circumstances allow.

19. Texas Law

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where another law must apply. Any dispute will be handled in a court or other forum with lawful jurisdiction over Graze & Grace and the dispute, unless the parties agree otherwise in writing.

20. Updates

We may update these Terms of Service as the website, services, technology, or law changes. The effective date above shows the current version posted on the site.
